Service agreement

Terms of Service

These terms govern use of the hosted PenEcho Cloud service. They do not replace or restrict the AGPL-3.0-only license that applies to the separate open-source PenEcho software.

1. Agreement

By creating an account, signing in, or using PenEcho Cloud, you agree to these Terms and acknowledge the Privacy Policy. If you use the service for an organization, you confirm that you have authority to accept these Terms for that organization.

If you do not agree, do not use the hosted service. You may still use separately distributed open-source PenEcho software under its applicable license.

2. Eligibility and accounts

You must be legally able to enter this agreement and meet the minimum age rules described in the Privacy Policy. Provide accurate account information and keep your credentials secure. You are responsible for activity performed through your account and for promptly notifying us if you suspect unauthorized access.

Do not share verification codes, passwords, session cookies, local device tokens, or model API keys. PenEcho support will not ask you to disclose a password or API key.

3. Trial-operation service

PenEcho Cloud is currently in trial operation. Features, limits, integrations, storage formats, availability, and eligibility may change at any time. We may maintain, update, suspend, limit, replace, or discontinue any part of the service without guaranteeing continued availability or backward compatibility.

The service may experience errors, interruptions, security incidents, corruption, or loss of data. PenEcho Cloud is not a backup service. You are responsible for keeping independent exports or local copies of all work that is important to you. We do not promise that data can always be recovered or that an experimental feature will become generally available.

4. Your content

You retain ownership of content you create or upload. You grant the PenEcho service operator a worldwide, non-exclusive, royalty-free license to host, copy, transmit, render, modify for technical formatting, back up, and otherwise process that content as reasonably needed to operate, secure, improve, support, or demonstrate requested service functionality, enforce these Terms, or comply with law. This license continues for as long as the content remains in active systems, backups, logs, caches, or legally required records.

You confirm that you have all rights and permissions needed to upload and process your content. PenEcho does not claim ownership of private Canvas content and does not use it to train PenEcho's own models.

5. Publishing public Crafts

You keep ownership. Publish is an open contribution, not a private share. Copying or sending a link only points someone to content under its existing access rules. Choosing Publish places that version in the public Craft commons and intentionally permits other people to view, copy, adapt, and “Take it further” under the licenses below.

You may publish only material you own or have authority to license. You must identify separately licensed third-party material when its terms require notice, attribution, source disclosure, or other conditions. Do not publish confidential information, personal data you lack permission to disclose, or material whose license conflicts with this section.

For a public Craft, you license visual and written content under Creative Commons Attribution-ShareAlike 4.0 International (CC BY-SA 4.0), embedded source code you have authority to license under the MIT License, and structured listing metadata such as public tags and categories under CC0 1.0. Downstream Crafters must preserve attribution, indicate changes, and license adapted visual and written content under the same CC BY-SA license. These licenses do not override third-party rights or licenses.

Each contributor owns their original additions; contributing does not transfer ownership of an ancestor. Each version records its parent, contribution note, invitation for the next Crafter, authorship snapshot, and applicable terms.

Required Public Craft ML License

The open collaboration licenses above and this model-training permission are separate. Publishing a new public Craft requires you to check the separate model-training box. When you check it, you grant PenEcho and its affiliates, contractors, service providers, successors, and assigns a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to collect, host, copy, reproduce, transform, format, annotate, label, combine, analyze, create datasets and derived materials from, and use your eligible public contribution to develop, train, fine-tune, test, evaluate, secure, improve, operate, distribute, and commercialize PenEcho models, model weights, datasets where lawful, and related products and services. This license is perpetual and irrevocable to the extent permitted by law, but does not waive privacy, publicity, moral, consumer, or data-protection rights that cannot legally be waived.

A complete lineage enters a training dataset only when every included contribution has the required recorded permission and the Craft has not been excluded for a rights, privacy, safety, or quality-control review. PenEcho may use automated tools to detect empty, duplicative, unsafe, or policy-violating submissions and to help organize metadata; PenEcho does not promise that an automated system can judge an idea's value. Private projects, drafts, link-only content, linked-device traffic, API keys, private prompts, and private model responses are not licensed for PenEcho model training by this section.

Existing lineage cannot be recalled merely by closing an account. Public licenses already granted for a published version and lawful downstream copies may continue. Privacy and data-protection requests, valid copyright notices, court orders, and other legal rights will still be reviewed and honored where applicable. PenEcho may hide, restrict, preserve, remove from discovery, exclude from datasets, or remove hosted material for safety, legal, moderation, security, or operational reasons. Publication does not promise permanent hosting.

6. AI features and linked devices

AI output may be incomplete, incorrect, or unsuitable. Review it before relying on it, especially for medical, legal, financial, safety-critical, or other high-impact decisions.

When you link a local device, PenEcho may relay request content to that device over encrypted HTTPS/WSS connections. The relay is not currently end-to-end encrypted. Local model API keys and CLI credentials must remain on your computer. If you select a third-party model provider, its terms and data practices also apply.

7. Acceptable use

You may not use PenEcho Cloud to:

  • break the law, infringe intellectual-property or privacy rights, or exploit or harm another person;
  • upload malware, attempt unauthorized access, probe private administrative routes, bypass rate limits, or disrupt the service;
  • misrepresent identity, automate fraudulent account creation, abuse credits, or use the service for spam or credential theft;
  • use AI features to create or facilitate unlawful, deceptive, or dangerous activity; or
  • resell the hosted service or represent PenEcho branding as your own without written permission.

Reasonable security research is welcome when performed under coordinated disclosure and without accessing other users' data. Contact us before testing that could affect production availability.

8. Credits and future paid features

Community Widget and Canvas sharing is currently free: credits are not required to publish, favorite, download, or use a community creation. Promotional or earned credits are account benefits for eligible Cloud services and for future credit-priced account features only when clearly presented. Credits do not cause the website to execute or host a private Canvas.

No refunds or cash conversion: credits are not money, deposits, electronic money, securities, or stored cash value. Credits cannot be withdrawn, transferred, sold, exchanged for cash or cryptocurrency, or redeemed outside PenEcho. Credits are non-refundable once added to an account, whether promotional, earned, administratively granted, or later purchased, except where applicable law requires otherwise.

PenEcho does not currently sell credits. Before any paid credit purchase or paid community feature is enabled, we will disclose the applicable price, conversion, usage, and expiration rules. We may correct credits obtained through error, fraud, or abuse. Legitimate administrative adjustments are recorded in the account credit ledger.

9. Open-source software, cloud service, and trademarks

License boundary: the separately distributed PenEcho open-source client is licensed under GNU AGPL-3.0-only. Your rights to use, inspect, modify, and redistribute that program come from the AGPL and are not reduced by these Terms.

PenEcho Cloud's proprietary server code, account and synchronization service, hosted website content, and operational systems are separate from the open-source client and are not offered under the AGPL unless a file or repository expressly says so. Third-party packages, fonts, and components remain under their own licenses and notices. Nothing in these Terms changes or expands those third-party licenses.

The PenEcho name and logo are governed separately by the project's trademark policy. Alternative commercial licensing may be available under the commercial license information.

10. Third-party services

PenEcho integrates with services such as AWS, Cloudflare, Google, GitHub, local command-line tools, and model providers. Those services may have separate terms, fees, availability, geographic restrictions, security practices, and privacy policies. PenEcho does not control and is not responsible for third-party services, their acts or omissions, or any resulting unavailability, loss, disclosure, or change to your data.

11. Suspension, termination, and deletion

You may stop using the service or request deletion from account settings. A deletion request currently enters a 30-day recovery period before permanent processing, but this process and timing may change. We may suspend, restrict, or terminate access for operational, security, legal, commercial, abuse-prevention, nonpayment, or policy reasons.

We may give notice or an opportunity to resolve an issue when practical, but may act immediately and without prior notice. You should export important content before closing an account because deletion or termination may make it unavailable. Sections that by nature should survive termination, including content licenses, license boundaries, disclaimers, and liability limits, remain in effect.

12. Disclaimers

To the maximum extent allowed by law, the trial-operation service is provided "as is," "as available," and at your own risk. PenEcho disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, compatibility, data preservation, and uninterrupted or error-free operation. We do not warrant that content will be saved, synchronized, recoverable, or free from loss or corruption. These disclaimers do not exclude rights that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent allowed by law, PenEcho, its operator, affiliates, suppliers, and contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, content, business, profits, revenue, savings, goodwill, opportunity, or service access, even if advised that such loss was possible.

Aggregate liability arising from or relating to the hosted service will not exceed the greater of USD 10 or the amount you paid directly to PenEcho for the hosted service during the three months before the event giving rise to the claim. Multiple claims do not increase this limit. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.

14. Changes to these Terms

We may update these Terms as the service evolves. The updated version becomes effective when posted or on a later date stated on this page. We may provide additional notice of material changes where required or reasonably practical. Continued use after the effective date means you accept the revised Terms; if you do not accept them, stop using the service and request account deletion.

15. Disputes, applicable law, and contact

Please contact us first so we can try to resolve a concern. These Terms are governed by the law applicable to the PenEcho service operator, without limiting mandatory consumer protections that apply where you live. Disputes may be brought before a court with lawful jurisdiction; these Terms do not require private arbitration.
